Senate Bill SB79 is a proposed new state housing law that would override local control and allow private developers to build dense residential complexes — up to 7 stories high — near any major transit stop, regardless of local zoning laws, infrastructure capacity, or community input.
What SB79 Does
- Eliminates local control over height, density, and parking near transit stops
- Mandates by-right approval of high-density housing — up to 120 units/acre and 75 feet high — even in areas currently zoned for small-scale development
- Sidesteps CEQA (California Environmental Quality Act), exempting qualifying projects from vital environmental review
- Displaces working families and small businesses by incentivizing demolition of lower-cost existing properties
- Allows development near “planned” — not yet built — transit stops, pushing high-rise construction into car-dependent areas without adequate transit service or infrastructure
